1. Acceptance of Terms
By accessing and using Digisales services, you accept and agree to be bound by the terms and provisions of this agreement. These Terms apply to all transactions conducted through our website, digital storefronts, and any associated platforms operated by Digisales. If you do not agree to these Terms, you must not use our services.
2. Digital Gift Card Terms & Conditions of Sale
2.1 Definitions
- Gift Card: Any digital code, prepaid card, or stored-value product sold by Digisales.
- Vendor: The retailer or platform that issues and/or redeems the Gift Card (e.g., Steam, PlayStation, Xbox, Google Play, Apple).
- You / Customer: The purchaser or recipient of the Gift Card.
- We / Us: Digisales, operated as an authorized digital goods retailer based in Toronto, Ontario, Canada.
2.2 User Accounts and Obligations
You agree not to use our services for any fraudulent, illegal, or unauthorized purposes. You must be of legal age in your province or territory to enter into binding agreements. If you are a minor, a parent or legal guardian must agree to these Terms on your behalf.
You are responsible for maintaining the security of your account credentials. You agree to provide accurate, current, and complete information when making purchases.
2.3 Purchase and Use of Digital Goods
All sales are final. Unless otherwise required by applicable Canadian law or provincial consumer protection legislation, all purchases of Digital Goods are non-refundable and non-exchangeable once the code has been delivered.
We are not responsible for lost, stolen, or misused codes once they have been delivered to you via the contact information you provided.
Exceptions may apply only in the following limited circumstances:
- The code is purchased and redeemed under the direct supervision of our staff.
- An incorrect code was purchased, and the code is verified as completely unused and valid.
- The code is defective and verified as non-functional through our internal verification process or confirmed as defective by the Vendor directly.
2.4 Code Verification & Anti-Fraud Measures
IMPORTANT: All digital codes sold by Digisales are sourced from authorized distributors and are verified as valid and active at the time of delivery. We maintain detailed records of all codes issued, including issuance timestamps, delivery records, and status at time of sale.
To protect against fraudulent claims, the following verification standards apply:
- All codes are checked and confirmed valid prior to delivery.
- We reserve the right to verify any claimed defect directly with the Vendor before processing any resolution.
- Claims that a code "did not work" or "was already used" without supporting evidence will not be accepted.
- If our records or Vendor confirmation indicates a code was valid at the time of delivery, no refund or replacement will be issued.
- Repeated or suspicious claims from the same customer may result in account suspension and refusal of future service.
- We reserve the right to report suspected fraud to relevant authorities, including local law enforcement or the Canadian Anti-Fraud Centre (CAFC).
2.5 Vendor Terms
Digital Goods are issued by third-party Vendors. Your use of these products is also subject to the Vendor's own terms and conditions, including any expiration dates or use restrictions. You are responsible for reviewing theVendor's terms before purchase or use.
2.6 Disclaimer of Vendor Liability
As a retailer and distributor, Digisales is not the issuer of Digital Goods and is not responsible for the quality, legality, service disruptions, or any other aspect of the products or services provided by the Vendor. You agree to seek remedies directly from the Vendor for issues related to their platforms or services.
2.7 Order Refusal & Fraud Prevention
We reserve the right to limit quantities, refuse orders, or cancel transactions at any time if we reasonably suspect fraud, unauthorized use, reselling activity, or any other misuse of our services. No compensation will be owed for refused or cancelled orders.
2.8 Usage Restrictions
Personal use only. All codes are for personal use only. Reselling, sharing, or transferring codes without our prior written consent is strictly prohibited.
Some codes are region-, currency-, or platform-specific. Customers are solely responsible for requesting the correct product for their account region and platform. We are not responsible for errors caused by incorrect information provided by the customer, including wrong email address, currency selection, product variant, or region.
2.9 Risk & Responsibility
Risk of loss passes to you upon delivery of the code. Treat codes like cash — lost, stolen, or misused codes will not be replaced once delivered.
We are not liable for losses arising from Vendor-related service issues, account bans, platform outages, or redemption failures occurring after the code has been delivered and confirmed valid.
2.10 Reporting Issues
Defective or non-functioning codes must be reported within 5 days of delivery. Reports submitted after this window will not be eligible for review.
All reports must be submitted via our official support channels (WhatsApp or support website) and must include all of the following:
- Your original purchase receipt or order confirmation.
- The full, unaltered code exactly as received.
- Your matching username or account ID used for the redemption attempt.
- Clear screenshots of the error message received, including any error codes.
- The date and time of the attempted redemption.
Incomplete submissions will not be reviewed. Once all required information is received, we will investigate and determine the appropriate resolution based on our findings and Vendor verification. Submission of a report does not guarantee a refund or replacement.
2.11 Fraud & Abuse Policy
All codes are for legitimate personal use only. Digisales actively monitors for fraudulent activity, including but not limited to false claims of non-delivery, claims of non-functional codes that were in fact valid, and coordinated abuse.
The following will result in immediate claim denial and may result in account suspension:
- Inability to provide a local account username or email showing the redemption attempt.
- Evidence that a code was redeemed successfully prior to the complaint.
- Providing falsified screenshots, altered receipts, or inaccurate account information.
- Multiple claims of non-functioning codes from the same account or contact information.
Digisales reserves the right to pursue legal remedies against individuals who engage in fraudulent claims, including civil action for damages and reporting to the Canadian Anti-Fraud Centre (CAFC) at 1-888-495-8501 or antifraudcentre.ca.
2.12 Username / Account ID Lock
All codes must be redeemed on the exact username or account ID you provided to us at the time of purchase. This information is logged and locked to your order record.
If your username or account ID changes, you must notify us before purchasing so we can update our records. We cannot provide support if the username or account ID does not match our records at the time of the reported issue.
3. Physical Gaming Products & Accessories Policy
3.1 Warranty
Hardware and accessories carry a 3-month limited warranty from the date of purchase, covering manufacturer defects only. Warranty does not cover physical damage, water damage, or misuse.
3.2 Video Games
- Returns are accepted within 14 days of purchase only if the item is defective.
- Non-defective returns are treated as trade-ins and subject to trade-in pricing.
- All returns require proof of purchase, original tags attached, and the item in the same condition as purchased.
- Non-defective returns incur a 20% restocking fee. Exceptions may apply at our discretion.
- Cash refunds are available only for defective items accompanied by a physical receipt. Otherwise, store credit will be applied.
4. Use License
Permission is granted to temporarily access and use materials available through Digisales for personal, non-commercial purposes only. This license does not include the right to redistribute, modify, reproduce, or use any materials for commercial purposes.
5. Disclaimer of Warranties
All materials and services provided by Digisales are offered on an "as is" basis. Digisales makes no warranties, expressed or implied, and disclaims all other warranties including implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by applicable Canadian law.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Digisales and its suppliers shall not be liable for any indirect, incidental, special, or consequential damages (including loss of data, profits, or business interruption) arising from your use of our services or inability to use our services, even if we have been advised of the possibility of such damages.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under Canadian law.
7. Third-Party Links
Digisales is not responsible for the content, accuracy, or practices of any third-party websites linked from our platform. The inclusion of any link does not imply endorsement or affiliation.
8. Modifications to Terms
Digisales may revise these Terms at any time. Updated Terms will be posted with a revised date. Continued use of our services after any modification constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
9. Privacy Policy
We collect and process your personal information in accordance with applicable Canadian privacy law, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial legislation.
Your information is used to process orders, prevent fraud, provide customer support, and for marketing communications you have consented to. We will not sell or share your personal information with unaffiliated third parties for their own marketing purposes without your consent.
You have the right to access, correct, or request deletion of your personal information. Contact us via our official support channels to exercise these rights.
10. Use of Likeness and Promotional Content
By accepting these Terms, you grant Digisales permission to use your name, image, likeness, voice, and any photographs or video recordings taken during interactions with our business for promotional purposes.
10.1 Permitted Uses
We may use your likeness in the following ways:
- Social media posts (Instagram, TikTok, Facebook, X/Twitter, etc.)
- Marketing and promotional videos
- Website content and online advertising
- Press releases and media coverage
- Any other promotional or marketing purposes
10.2 Rights and Releases
- You waive any right to inspect or approve the finished materials in which your likeness appears.
- You release Digisales from any claims related to the use of your likeness for the purposes described above.
- This permission is perpetual and may be used without additional compensation.
- You confirm you are of legal age or have parental/guardian consent if you are a minor.
10.3 Opt-Out Rights
If you do not wish to have your likeness used in promotional materials, please inform a Digisales staff member immediately. You may also contact us via WhatsApp or email to request removal of existing content featuring your likeness, where reasonably possible. Opting out does not affect your ability to use our services.
11. WhatsApp Communications Consent
By accepting these Terms, you consent to receive communications from Digisales via WhatsApp, including order confirmations, delivery updates, account notifications, and promotional offers. We will only use WhatsApp to communicate directly with you about Digisales products, services, and promotions.
Your phone number and information will only be used to deliver these communications. You may opt out of promotional WhatsApp communications at any time by contacting our support team. This consent is provided in accordance withCanada's Anti-Spam Legislation (CASL).
12. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. You irrevocably submit to the exclusive jurisdiction of the courts of Ontario for the resolution of any disputes arising from these Terms or your use of our services.
Before initiating any formal proceedings, you agree to first contact us in good faith to attempt to resolve the dispute informally.
